By accessing or using any of the applications, websites, and services provided by ThisCity (Apps & Services) ("we", "our", or "us"), including but not limited to "ThisCity Quotes", "ThisCity POS", "Nyimbify", "Arrived", "FNChat", "Events", "FleetLog", and all other current and future applications published by ThisCity, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Service

ThisCity provides a unified platform of software solutions designed for Small and Medium Enterprises (SMEs), logistics, event management, messaging, and digital education. Our services include document generation, inventory management, point-of-sale systems, fleet tracking, and custom software development. These terms apply to all digital products offered under the ThisCity banner.

3. User Accounts and Responsibilities

• Account Security: You are responsible for maintaining the confidentiality of your account credentials (including PINs and biometric access) and for all activities that occur under your account.
• Data Accuracy: You are solely responsible for the accuracy of the data you enter into our systems, including organization details, customer information, inventory, and financial records.
• Share Codes & Privacy: Our services allow you to "Publish" documents or share data via unique links. You are responsible for the distribution and security of these access points.
• Lawful Use: You agree to use our services only for lawful purposes and in accordance with these Terms.
• Single-User vs. Organization Mode: Some apps (like Nyimbify) are designed for personal use, while others are organization-based. You agree to use each app according to its intended data model.

4. Payments, Credits, and Subscriptions

• Monetization: Certain features ecosystem-wide may require "Credits" or active subscriptions. These are handled within the respective applications.
• Refunds: All purchases are final and non-refundable, except as required by law.
• Pricing: We reserve the right to change our pricing and credit requirements at any time with reasonable notice.

5. Limitation of Liability

To the maximum extent permitted by law, ThisCity (Apps & Services) shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages.
• Any loss of profits, revenue, data, or use.
• Any errors or omissions in any content or documents generated using our services.
• Any fraud or misrepresentation by users of our services.
• The quality or delivery of goods or services provided by users to their customers.

Our total liability for any claim arising out of or relating to these Terms or our services shall not exceed the amount paid by you to us in the twelve months preceding the claim.

6. Intellectual Property

All content, features, and functionality of our services, including but not limited to software, design, and logos, are the exclusive property of ThisCity (Apps & Services) and are protected by international copyright, trademark, and other intellectual property laws.

7. Termination

We reserve the right to terminate or suspend your account and access to our services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malawi, without regard to its conflict of law provisions.

We may update these Terms of Service from time to time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the services after such changes constitutes your acceptance of the new Terms.
